Terms of Service

By downloading, installing, accessing, or using Presnly (the “Service”), including our iOS, iPadOS, macOS, and watchOS applications, website at presnly.com, and any related services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Presnly (“we,” “us,” or “our”). We may update these Terms from time to time, and your continued use of the Service after such changes constitutes acceptance of the revised Terms.

You must be at least 13 years of age to use Presnly. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet all eligibility requirements.

To access certain features, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Immediately notify us of any unauthorized use of your account

You may authenticate using email/password, Sign in with Apple, or Sign in with Google. We are not responsible for any loss or damage arising from your failure to maintain the confidentiality of your account credentials.

Presnly offers both free and paid subscription plans. Paid plans (“Pro” and “Team”) are billed on a monthly or annual basis through Stripe, our payment processor.

• Pricing. Current pricing is displayed on our website and within the app. Prices are in USD and may vary by region.
• Recurring billing. Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
• Upgrades & downgrades. You may change your plan at any time. Upgrades take effect immediately; downgrades take effect at the end of the current billing period.
• Refunds. Refund requests are handled on a case-by-case basis. Contact support@presnly.com within 14 days of purchase for assistance.
• Taxes. Prices may be subject to applicable taxes, which will be calculated and added at checkout.

We may offer free trials for paid plans. At the end of the trial period, your account will automatically convert to a paid subscription unless you cancel before the trial expires. You will be notified before any charges are applied.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Presnly on devices that you own or control, solely for your personal or internal business purposes.

This license does not include the right to sublicense, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Service.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Interfere with or disrupt the integrity or performance of the Service
• Use automated tools, bots, or scrapers to access the Service
• Reproduce, duplicate, sell, resell, or exploit any portion of the Service without express permission
• Upload or transmit viruses, malware, or other harmful code
• Impersonate any person or entity, or misrepresent your affiliation

The Service, including all content, features, functionality, software, designs, graphics, trademarks, and logos, is owned by Presnly and protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited license described above.

The Presnly name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Presnly. You may not use such marks without our prior written permission.

You retain full ownership of all content you create, upload, or manage through Presnly, including presentations, scripts, notes, and rehearsal data (“User Content”). We do not claim any ownership rights over your User Content.

By using the Service, you grant us a limited license to process and store your User Content solely for the purpose of providing and improving the Service. We will not access, use, or share your User Content for any other purpose without your explicit consent.

Presnly integrates with third-party presentation applications including Apple Keynote, Microsoft PowerPoint, Google Slides, and Canva. These integrations are provided for convenience, and we are not responsible for the availability, functionality, or content of third-party services.

Your use of third-party services is governed by their respective terms of service and privacy policies. We encourage you to review these terms before using any third-party integrations.

We strive to maintain high availability of the Service, but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

You may terminate your account at any time by deleting your account through the app or by contacting support@presnly.com. Upon termination, your right to use the Service ceases immediately.

We may suspend or terminate your access to the Service at any time, with or without cause, including if we reasonably believe you have violated these Terms. Upon termination, we may delete your account and associated data in accordance with our Privacy Policy.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, secure, or available at all times, or that the results obtained from the Service will be accurate or reliable.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRESNLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, WHETHER CAUSED BY TORT, BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100 USD.

You agree to indemnify, defend, and hold harmless Presnly and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of any third party.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the Service or by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

If you do not agree with the revised Terms, you must stop using the Service and delete your account before the changes take effect.
